1. Acceptance of Terms
By creating an account or using Presente Voice AI Companion (the "App"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy.
2. Eligibility
You must be at least 13 years old to use the App. If you are under 18, you must have parental or guardian consent. By using the App, you represent that you meet these requirements.
3. Account Responsibilities
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree to provide accurate and complete information.
- You are responsible for all activities that occur under your account.
- You must notify us immediately of any unauthorized use of your account.
4. Acceptable Use
You agree not to:
- Use Sol to harm yourself or others.
- Share inappropriate, offensive, or illegal content with Sol.
- Attempt to hack, reverse engineer, or compromise the App's security or Sol's AI systems.
- Use the App for commercial purposes without authorization.
- Impersonate others or create fake accounts.
- Attempt to manipulate or exploit Sol's responses for malicious purposes.
- Use Sol as a substitute for emergency or crisis mental health services.
5. Your Conversations with Sol
- You retain ownership of your conversations, journal entries, and content shared with Sol.
- By using the App, you grant us a license to process and store your conversations to provide Sol's services.
- You are solely responsible for the content you share with Sol.
- We reserve the right to review conversations if there are safety concerns or violations of these Terms.
6. Medical Disclaimer - Sol Is Not a Licensed Therapist
IMPORTANT - PLEASE READ CAREFULLY:
- Wellness companion, not medical advice: Sol is an AI-powered wellness tool designed to provide emotional support, mindfulness guidance, and daily practice recommendations. Sol is not a licensed therapist, psychologist, psychiatrist, doctor, or other medical professional.
- No diagnosis, treatment, or professional care: Presente does not provide medical advice, diagnosis, or treatment. Sol's responses are generated by AI models and should not be considered professional mental health care or a substitute for therapy.
- No doctor-patient relationship: Using Presente does not create a therapist-patient, doctor-patient, or any other licensed professional-client relationship.
- Always seek professional help when needed: If you are experiencing severe depression, anxiety, suicidal thoughts, thoughts of self-harm, or any mental health crisis, you should immediately contact:
- Your local emergency services number (for example, the national emergency number in your country).
- A local crisis hotline or mental health helpline in your region.
- A licensed mental health professional (such as a therapist, psychologist, or psychiatrist).
- A trusted person (family member, friend, or caregiver) who can help you get support.
You can also use global helpline directories such as https://findahelpline.com to look up crisis resources available in your country.
Sol and Presente cannot provide emergency or real-time crisis intervention. Do not delay seeking professional help because of information or support you receive from Sol.
7. Crisis Resources Available in App
Presente may provide you with links or information about crisis and support resources when concerning language or potential crisis indicators are detected in your conversations. For example, the App may:
- Encourage you to contact your local emergency number or a nearby crisis service.
- Suggest visiting https://findahelpline.com or similar directories to locate helplines in your region.
- Remind you to speak with a licensed mental health professional or a trusted person in your life.
These features are supportive prompts only. Detection is not perfect, is not monitored in real time, and may fail to recognize signs of crisis. You should never rely on Presente as an emergency response system.
We do not operate or control any third-party helplines or directories, and we are not responsible for their availability, accuracy, or actions.
8. Intellectual Property
All rights, title, and interest in the App, including its design, code, trademarks, and content, are owned by Virtus Opus or its licensors. You may not copy, modify, distribute, or create derivative works based on the App without our written permission.
9. Disclaimer of Warranties
The App is provided "as is" without warranties of any kind, whether express or implied. We do not guarantee that the App will be error-free, secure, or uninterrupted. We are not responsible for any harm resulting from your use of the App, your reliance on Sol's responses, or your inability to access the App.
10. Limitation of Liability
To the maximum extent permitted by law, Virtus Opus shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the App, even if we have been advised of the possibility of such damages.
11. Pricing and Service Changes
Current Free Access
Presente is currently offered free of charge while we develop and improve the service based on user feedback. This allows us to refine Sol’s capabilities and ensure the best possible experience.
Future Pricing
We reserve the right to introduce subscription pricing or premium features in the future. We will provide advance notice before implementing any pricing changes so you can make informed decisions about your continued use.
Early User Benefits
Users who create accounts during the free period may receive special pricing, grandfathered access, or other benefits if premium features are introduced.
No Guarantee of Free Access
While the App is currently free, we do not guarantee that all features will remain free indefinitely. We will communicate any changes at least 30 days in advance via email and/or in-app notifications.
Subscription and Payment Processing
- If subscription pricing is introduced, fees will be processed through the app store platform (e.g., Apple App Store).
- Subscriptions may auto-renew unless canceled at least 24 hours before the renewal date.
- Refunds will be subject to the policies of the app store platform.
- You will be able to manage or cancel subscriptions through your app store account settings.
12. Termination
We reserve the right to suspend or terminate your account at any time for violations of these Terms, suspected misuse, or as required by law. You may delete your account at any time through the App settings.
13. Changes to Terms
We may update these Terms from time to time. Continued use of the App after changes become effective constitutes acceptance of the updated Terms. We will notify you of significant changes via email or in-app notification.
14. Governing Law
These Terms are governed by the laws of the jurisdiction in which Virtus Opus operates, without regard to conflict-of-law principles.
15. Dispute Resolution
Any disputes arising from these Terms or your use of the App will be resolved through binding arbitration or another dispute resolution mechanism, except where prohibited by law. Nothing in this section limits any non-waivable rights you may have under applicable consumer protection laws.
